1. Agreement to These Terms

These Terms & Conditions (“Terms”) govern your access to and use of Listing Amplified, including its websites, applications, listing tools, Media Kits, generated content, landing pages, sharing tools, Standard Reels, lead forms, analytics, and related services (collectively, the “Platform”).

Listing Amplified is currently operated by Robin Nelson, an individual (“Listing Amplified,” “we,” “us,” or “our”).

By creating an account, accepting these Terms, or using the Platform, you agree to these Terms and our Privacy Policy. If you participate in the Founding Beta, you also agree to the Founding Beta Participation Agreement.

If you do not agree, do not use the Platform.

2. Eligibility and Accounts

The Platform is intended for real estate professionals who are at least 18 years old and legally able to enter into this agreement.

You agree to:

  • Provide accurate and current account, license, brokerage, and professional information.
  • Maintain the security of your account credentials.
  • Promptly update information that becomes inaccurate.
  • Use only your own account unless Listing Amplified expressly authorizes otherwise.
  • Notify us promptly if you believe your account has been accessed without authorization.

Listing Amplified may request information reasonably necessary to verify a professional license, brokerage affiliation, identity, listing relationship, or account eligibility. Verification by Listing Amplified is for Platform access purposes and is not a guarantee, endorsement, or certification of any user.

3. Platform Role

Listing Amplified provides marketing, content-generation, listing-amplification, attribution, lead-routing, and collaboration tools for real estate professionals.

Listing Amplified is not:

  • A real estate brokerage.
  • A multiple listing service.
  • A party to any real estate transaction.
  • A provider of legal, tax, brokerage, MLS, advertising, or regulatory-compliance advice.
  • An agent, employer, partner, or representative of any Platform user.

Users remain independently responsible for their professional services, advertisements, communications, clients, brokerage obligations, and transactions.

4. Founding Beta

The Platform may be offered through a limited Founding Beta governed by the separate Founding Beta Participation Agreement.

During the initial complimentary Founding Beta:

  • No credit card or payment is required.
  • Buyer Agent participation is free.
  • Each eligible Listing Agent may receive one complimentary listing.
  • Additional beta listings may be granted at Listing Amplified’s discretion for testing purposes.
  • Nothing automatically converts to a paid plan.
  • Future paid access requires separate affirmative enrollment after applicable pricing and billing terms are disclosed.

Beta features may be incomplete, changed, removed, interrupted, or discontinued. Participation in the beta does not guarantee continued access, permanent features, permanent pricing, or future availability.

5. Listing Agent Responsibilities

A user who uploads, creates, imports, manages, or publishes a listing through the Platform represents and warrants that the user:

  • Is authorized to market the property.
  • Has obtained any seller, brokerage, MLS, photographer, videographer, copyright-owner, or other permission required for the intended use.
  • Has the right to upload and authorize use of all photographs, videos, descriptions, logos, floor plans, property details, and other submitted materials.
  • Will not upload confidential, unlawfully obtained, misleading, infringing, or unauthorized material.
  • Will keep the listing’s price, status, availability, features, and other material information reasonably current.
  • Will identify or remove material that cannot lawfully be redistributed or used by other agents.

Listing Amplified does not independently verify every listing, property fact, copyright, MLS rule, seller instruction, brokerage policy, or media license.

6. Amplifying Agent Responsibilities

A user who requests access to, shares, downloads, promotes, or otherwise amplifies another agent’s listing may use the listing materials only:

  • For the authorized listing.
  • While amplification permission remains active.
  • In accordance with required “Shared By,” “Listing Courtesy Of,” brokerage, license, and other attribution.
  • In compliance with applicable laws, brokerage policies, MLS rules, fair-housing requirements, advertising rules, and social-platform policies.

Amplifying Agents are responsible for every advertisement, caption, video, post, message, landing-page link, or other communication they personally publish.

Users may not remove, obscure, or misrepresent mandatory attribution or imply that they are the Listing Agent when they are not.

7. Permission Changes and Listing Status

Listing Agents and Listing Amplified may deny, revoke, restrict, or end amplification permission.

When permission is revoked or a listing becomes sold, withdrawn, expired, canceled, unavailable, or otherwise unsuitable for continued promotion:

  • New access, generation, or downloads may be disabled.
  • Users must stop creating and publishing new advertisements for that listing.
  • Users must remove or discontinue existing promotional content when reasonably possible and when required by the Listing Agent, brokerage, MLS, law, or Platform notice.
  • Previously downloaded material may not be reused for another property or purpose.

Listing Amplified may remove listings, generated materials, links, or access when reasonably necessary to address status changes, permission disputes, legal concerns, security issues, or Platform misuse.

8. AI-Generated and Automated Content

The Platform may use artificial intelligence and automated systems to generate descriptions, captions, scripts, images, videos, suggested claims, landing-page materials, and other content.

Generated content may contain errors, omissions, unsuitable wording, inaccurate details, or content that does not satisfy a brokerage, MLS, advertising platform, or regulatory requirement.

Before publishing, users must:

  • Review the complete output.
  • Confirm all property and professional information.
  • Correct errors and remove unsupported claims.
  • Confirm compliance with fair-housing and advertising requirements.
  • Obtain any necessary brokerage, seller, MLS, or rights-holder approval.

Listing Amplified does not guarantee that generated content is accurate, complete, legally compliant, MLS compliant, or suitable for a particular use.

9. User Content and Platform License

Users retain the ownership rights they hold in material they submit to the Platform.

By uploading or submitting content, the user grants Listing Amplified a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, modify, create derivative marketing materials from, display, transmit, and distribute that content as reasonably necessary to:

  • Operate and improve the Platform.
  • Generate requested Media Kits, landing pages, reels, and related materials.
  • Display participating listings.
  • Provide authorized materials to approved agents.
  • Allow approved agents to publish authorized listing marketing outside the Platform.
  • Maintain security, backups, and records.
  • Comply with legal obligations.

This license does not give Listing Amplified ownership of the user’s original content. The user must have sufficient rights to grant this license.

The license continues for as long as reasonably necessary to provide the service, preserve authorized records, address disputes, maintain backups, or satisfy legal obligations. Public display and new marketing use should cease within a reasonable period after content is removed or authorization ends, subject to existing copies, lawful records, and technical backup cycles.

10. Public Professional Profiles

Professionally verified users may receive a basic profile on Amplified Agents — Powered by Listing Amplified, as disclosed during onboarding.

A public profile may include professional information such as the user’s name, profile photo, brokerage, license information, professional contact information, service areas, biography, social links, and other fields designated for public display.

Users are responsible for keeping public professional information accurate and may request correction or removal by contacting support@listingamplified.com, subject to reasonable verification and record-retention requirements.

Private account information must not be publicly displayed unless the user has provided it for public professional use or otherwise authorized its publication.

11. Leads and Communications

The Platform may collect and route inquiries or leads based on listing ownership, amplification attribution, sharing links, or other Platform activity.

Listing Amplified does not guarantee:

  • Any minimum number of leads, views, clicks, shares, inquiries, clients, transactions, or commissions.
  • The identity, accuracy, intent, financial qualifications, or responsiveness of any lead.
  • That every external social-media action can be tracked.
  • That a lead will result in a professional relationship or transaction.

Users are responsible for obtaining any consent required before calling, texting, emailing, marketing to, or otherwise contacting a lead.

12. Acceptable Use

Users may not:

  • Violate any law, professional rule, brokerage policy, MLS rule, contract, intellectual-property right, privacy right, or Platform authorization.
  • Upload false, misleading, discriminatory, infringing, malicious, or unauthorized content.
  • Scrape, crawl, harvest, copy, or systematically extract Platform data or content.
  • Reverse engineer, decompile, probe, clone, or attempt to recreate the Platform.
  • Use Platform content, prompts, outputs, workflows, or data to train, develop, benchmark, or improve a competing product or AI system without written permission.
  • Circumvent access controls, attribution, listing permissions, tracking, security, usage limits, or account restrictions.
  • Introduce malware or interfere with Platform availability.
  • Access another user’s account or private information without authorization.
  • Use the Platform for spam, deceptive lead generation, unlawful discrimination, or harassment.

13. Third-Party Services

The Platform may rely on or link to third-party services, including hosting, database, authentication, artificial-intelligence, email, analytics, referral, social-media, video, and future payment providers.

Third-party services may have their own terms, privacy practices, availability, and limitations. Listing Amplified is not responsible for third-party websites or services outside its reasonable control.

14. Future Fees and Paid Services

No payment or credit card is required for the initial complimentary Founding Beta described in the Founding Beta Participation Agreement.

Listing Amplified may later offer one-time purchases, recurring subscriptions, promotional pricing, founder pricing, or other paid services.

Before charging a user, Listing Amplified will disclose the applicable price, billing frequency, included features, important limits, renewal terms, cancellation method, and refund terms. A user will not be automatically enrolled in a paid plan solely because the user participated in the complimentary beta.

Paid access will require separate affirmative enrollment. Any future payment-specific terms presented at enrollment or checkout will supplement these Terms.

15. Listing Amplified Intellectual Property

Except for user-owned content, the Platform and its software, interface, branding, templates, workflows, designs, databases, documentation, prompts, and other proprietary materials are owned by or licensed to Listing Amplified.

These Terms provide a limited, revocable, non-transferable right to use the Platform for its intended professional purpose. They do not transfer ownership or grant the right to copy or create a competing service.

16. Copyright Concerns

If you believe material on the Platform infringes your copyright, contact copyright@listingamplified.com with:

  • Your name and contact information.
  • Identification of the copyrighted work.
  • Identification and location of the disputed material.
  • A statement explaining why you believe the use is unauthorized.
  • A statement that the information provided is accurate.
  • Your physical or electronic signature.

Listing Amplified may disable disputed material while reviewing a complaint, notify the affected user, request additional information, and terminate repeat infringers when appropriate.

This section is a practical beta complaint process and does not represent that Listing Amplified has registered a formal DMCA designated agent.

17. Suspension and Termination

Users may stop using the Platform at any time.

Listing Amplified may suspend, restrict, or terminate an account or remove content when reasonably necessary because of:

  • A violation of these Terms or another Platform agreement.
  • A listing or media-permission dispute.
  • Suspected fraud, abuse, infringement, or unlawful activity.
  • Security or privacy concerns.
  • Professional-license or verification concerns.
  • Risk to users, the Platform, or third parties.
  • Discontinuation or material change of the beta or Platform.

Termination does not eliminate obligations that reasonably survive, including content rights already granted for completed services, confidentiality, ownership, disclaimers, liability limitations, indemnification, and dispute provisions.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Platform is provided “as is” and “as available.”

Listing Amplified does not promise that the Platform will be uninterrupted, error-free, secure, complete, accurate, continuously available, or suitable for every brokerage, MLS, transaction, device, or marketing channel.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, Listing Amplified and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, reputational harm, regulatory consequences, or business interruption arising from use of or inability to use the Platform.

To the fullest extent permitted by law, total liability arising from the Platform will not exceed the greater of:

  • The amount the user paid Listing Amplified during the 12 months preceding the event giving rise to the claim; or
  • One hundred dollars.

These limitations do not apply where liability cannot legally be limited.

20. Indemnification

To the fullest extent permitted by law, a user agrees to defend, indemnify, and hold harmless Listing Amplified and its operator from third-party claims, losses, liabilities, damages, judgments, and reasonable costs arising from:

  • The user’s uploaded content.
  • The user’s listing, media, or marketing permissions.
  • Advertising or communications published by the user.
  • The user’s professional services or transaction activity.
  • The user’s violation of these Terms, applicable law, brokerage policy, MLS rule, or third-party rights.

Listing Amplified will provide reasonable notice of a covered claim and may participate in its defense.

21. Changes to These Terms

Listing Amplified may update these Terms as the Platform changes.

The updated version will display a revised date. When changes are material, Listing Amplified may provide additional notice or require renewed acceptance.

Continued use after the effective date of an update constitutes acceptance only to the extent permitted by law. If a user does not agree to revised Terms, the user must stop using the Platform.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes relating to the Platform or these Terms will be brought in the state or federal courts serving Contra Costa County, California.

Before filing a claim, the parties are encouraged to contact one another and attempt in good faith to resolve the dispute informally.

23. General Terms

If any provision is found unenforceable, the remaining provisions remain in effect.

A failure to enforce a provision is not a waiver.

Users may not assign their rights under these Terms without written permission. Listing Amplified may assign these Terms as part of a future business reorganization, transfer, or sale.

These Terms, the Privacy Policy, the Founding Beta Participation Agreement when applicable, and any expressly incorporated program or checkout terms form the agreement between the user and Listing Amplified.
